Objectives of the Network

  • To enhance the effective and practical application by Registrars of Community instruments and Conventions in force between Member States.
  • To establish and maintain an information system for the members of the ELRN via an ELRN website.
  • To establish and maintain an information system for the public via an ELRN website.
  • To enhance the smooth operation of procedures with cross-border impact and the facilitation of cooperation between Registrars in Member States and also with relevant EU authorities.
  • Other objectives may be set by agreement between the members of the ELRN and documented in an amendment to this Constitution.

ELRN Contact Points

  • Every member of the ELRN shall appoint one or more persons as a Contact Point.
  • A Person appointed as a Contact Point must be a Registrar with a legal background and adequate knowledge of the English Language
  • A Contact Point shall
    • Respond to a request from another Contact Point by providing all information to enable cooperation between the Member States by establishing the most appropriable direct contacts for each enquiry.
    • Provide the other Contact Points with information about their respective Domestic Law and other formal or substantive aspects arising in cross-border cases brought before the Land Registers.
    • Provide guidance to their Land Registry organisation about the applicable Community Law including competent authorities and specific procedures when Community law applies to Land registry procedures.
    • Facilitate coordination of the processing of requests for judicial registrar cooperation in the relevant Member State and European authorities in a more general sense.
    • Collaborate in the organisation and participate in the meetings of the Contact Points.
    • Assist with the preparation and updating of the information system to the public.

In order to preserve the necessary independence of the role of land registrars, the information provided by the Contact Points shall not be binding.

Operation of the Network

The ELRN will work by electronic means using secure communication systems and ICT tools must be developed to provide the Contact Points with adequate identification and authentication tools.

A specific procedure must be created to deal with the information and cooperation requests sent through the ELRN. Appropriate deadlines will be set for answers to be provided to requests and Contact Points will use their best endeavours to respond accordingly.

The official language of the ELRN will be English. Relevant information as well as national legislation may also be offered in its original language. The contact points will be compelled to use the English language in their activities.
